Declaration of Rights and Freedoms of a Citizen of the Russian Republic

This Declaration is intended to provide all citizens with the conditions for prosperity and the building of a just state and proclaims the principles on which the Constitution and Laws of the Russian Republic are built.

Human rights shall take precedence over the interests of the State. Human life and dignity are inviolable. It is the duty of citizens and the authorities of the Russian Republic to respect and protect them. The following provisions and fundamental rights and freedoms of citizens are based on the principles of the rule of law and have direct effect:

1. All are born equal in rights.

2. Everyone shall have the right to life and inviolability of the person, protection of his honour and dignity.

3. Citizens have the right to acquire, carry and use weapons.

4. Capital punishment is prohibited.

5. Everyone has the right to inviolability of private life, personal and family secrecy, secrecy of correspondence and telephone conversations.

6. Everyone is equal before the law and the court.

7. No one shall be favoured or discriminated against on the basis of gender, race, nationality, language, origin, property and official status, place of residence, attitude to religion, beliefs, membership of public associations.

8. Everyone shall be guaranteed the right to receive qualified legal assistance. Everyone detained, remanded in custody or accused of committing an offence shall have the right to be assisted by a lawyer (defence counsel) from the moment of actual detention, remand in custody or indictment, respectively.

9. No one shall be obliged to testify against himself, his spouse or close relatives.

10. Torture is prohibited.

11. The rights of victims of crime and abuse of power shall be protected by law. Victims have the right to access to justice and compensation for the damage caused.

12. Everyone shall have the right to health care and medical assistance.

13. Basic general education shall be compulsory in the territory of the Russian Republic and shall be free of charge for any person on the territory of the Russian Republic. Responsibility for its receipt by a minor rests with his parents or guardians.

14. Citizens shall be guaranteed access to higher education. Higher educational institutions shall be self-governing.

15. The right to property is inviolable and may be restricted only by court judgement.

16. The right to inheritance is guaranteed.

17. Everyone has the right to housing.

18. The home is inviolable. No one may enter a dwelling against the will of its occupants except on the basis of a judicial act.

19. Censorship and monopolisation of the dissemination of information shall be prohibited.

20. Everyone shall be guaranteed freedom of speech. No one may be prosecuted for expressing his or her opinion and beliefs.

21. Everyone shall be guaranteed freedom of conscience. No one may be persecuted on the grounds of religion, attitude or affiliation to religion.

22. Everyone shall have the right to freely seek, receive, transmit, produce and disseminate information by any lawful means. Information from open sources, as well as information and data concerning public activities and property of citizens holding elected office and public servants may not be classified as state secrets.

23. Citizens shall have the right to assemble peacefully, to hold pickets, as well as to hold meetings, rallies, demonstrations and processions with notification of the relevant executive authority.

24. A citizen has the right to become a voter. Voters have the right to elect and be elected, as well as to participate in referendums.

25. Citizens have the right to participate in the administration of justice, including through the election of judges.

26. Citizens exercise control over the activities of state security, law enforcement and FSIN bodies through representative power by electing heads of municipal police, through public supervisory commissions, as well as through the mass media and any other forms of public control.

27. The realisation of human and civil rights and freedoms shall be based on internationally established principles and norms.
