Act on the Transitional Period

We, the Congress of People's Deputies of Russia,

Relying on the Fundamental Declaration of the Congress of People's Deputies,

Establish the final political bankruptcy of the Putin regime,

We declare the establishment of the Russian Republic as the legal successor of the Russian Federation,

We appeal to representatives of Russian regions, countries of the world, international organizations, as well as to Russian civil servants and citizens of Russia to recognize the new system of power,


We accept this Act as the legal basis for the existence of the new state during the transitional period.


Article 1

  1. Recognize the state of the Russian Federation - Russia, as a subject of international law, as having ceased to exist.
  2. Terminate the powers of the President of the Russian Federation, the Government of the Russian Federation, the Federal Assembly of the Russian Federation, and the Constitutional Court of the Russian Federation.

Article 2

  1. To establish the Russian Republic within the borders of the Russian Federation - Russia as of February 19, 2014. The Russian Republic shall assume the rights and obligations arising from international treaties concluded by the Russian Federation - Russia and shall be its legal successor in all legal relations.
  2. The Congress of People's Deputies is the supreme body of state power in the Russian Republic for the period until the date of the first session of the elected Parliament of the Russian Republic (the "Transitional Period").
  3. The Congress of People's Deputies shall adopt laws, resolutions and other normative legal acts that shall have binding legal force throughout the entire territory of the Russian Republic, and, after the official publication of the results of voting for the draft Constitution of the Russian Republic, throughout the territory of all constituent entities of the Russian Republic that supported the draft Constitution of the Russian Republic.
  4. To establish that the heads of the federal executive authorities and the heads of the executive authorities of the constituent entities of the Russian Federation shall perform their duties until the Congress of People's Deputies forms a new structure of the executive authorities and appoints new heads of the relevant authorities.
  5. To propose that the constituent entities of the Russian Federation begin negotiations on the conditions of their being part of the Russian Republic.
  6. To begin a nationwide discussion of the draft of the new Constitution of the Russian Republic on the basis of the draft prepared by the Constitutional Working Group of the Congress of People's Deputies. To establish that a nationwide vote on the Constitution of the Russian Republic shall be held in each of the constituent entities of the Russian Republic within a period of one year from the entry into force of this Act.

Article 3

To recognize as illegal and null and void:

- "Treaty between the Russian Federation and the Republic of Crimea on the admission of the Republic of Crimea to the Russian Federation and the formation of new entities within the Russian Federation" of 18.03.2014

- Federal Constitutional Law No. 6-FKZ of 21.03.2014 "On the Admission of the Republic of Crimea to the Russian Federation and the Establishment of the Republic of Crimea and the City of Federal Significance Sevastopol as New Entities within the Russian Federation";

- Decree of the President of the Russian Federation of 21.02.2022 No. 71 "On the Recognition of the Donetsk People's Republic";

- Decree of the President of the Russian Federation of 21.02.2022 No. 72 "On Recognition of the Lugansk People's Republic";

- "Treaty on friendship, cooperation and mutual assistance between the Russian Federation and the Donetsk People's Republic" of 21.02.2022;

- "Treaty of Friendship, Cooperation and Mutual Assistance between the Russian Federation and the Lugansk People's Republic" of 21.02.2022;

- "Treaty between the Russian Federation and the Donetsk People's Republic on the admission of the Donetsk People's Republic to the Russian Federation and the formation of a new entity within the Russian Federation" of 30.09.2022;

- "Treaty between the Russian Federation and the Lugansk People's Republic on the Admission of the Lugansk People's Republic to the Russian Federation and the Establishment of a New Entity within the Russian Federation" of 30.09.2022;

- Federal Constitutional Law No. 5-FKZ of 04.10.2022 "On the Admission of the Donetsk People's Republic to the Russian Federation and the Establishment of the Donetsk People's Republic as a New Entity within the Russian Federation";

- Federal Constitutional Law No. 6-FKZ of 04.10.2022 "On the Admission of the Lugansk People's Republic into the Russian Federation and the Establishment of a New Entity - the Lugansk People's Republic";

- "Treaty between the Russian Federation and the Kherson Region on the Admission of the Kherson Region to the Russian Federation and the Establishment of a New Subject within the Russian Federation" of 30.09.2022;

- "Treaty between the Russian Federation and Zaporozhye Oblast on the admission of Zaporozhye Oblast to the Russian Federation and the formation of a new subject within the Russian Federation" of 30.09.2022;

- Federal Constitutional Law No. 8-FKZ of 04.10.2022 "On the Admission of Kherson Oblast to the Russian Federation and the Establishment of a New Subject - Kherson Oblast - within the Russian Federation";

- Federal Constitutional Law No. 7-FKZ of 04.10.2022 "On the Admission of Zaporozhye Oblast to the Russian Federation and the Establishment of a New Subject - Zaporozhye Oblast - within the Russian Federation";

To recognize as illegal and invalid all legislative and other normative legal acts adopted in connection with the above treaties, Federal Constitutional Laws, Presidential Decrees.

Article 4

  1. To recognize as invalid the amendments made to the Constitution of the Russian Federation starting from March 21, 2014.
  2. Until the entry into force of the Constitution of the Russian Republic, Chapters 1, 2, and 8 of the Constitution of the Russian Federation shall be valid in the transitional version adopted by the Congress of People's Deputies.
  3. To establish that chapters 1, 2 and 8 of the Constitution of the Russian Federation other than 1, 2 and 8, federal constitutional laws, federal laws of the Russian Federation and laws of the constituent entities of the Russian Federation, as well as decrees, resolutions and other normative legal acts of the Russian Federation, its constituent entities and local self-government bodies shall be in effect during the transitional period to the extent that they do not contradict decisions, laws, resolutions and other normative legal acts of the Congress of People's Deputies and the government bodies formed by it.
  4. The following federal laws of the Russian Federation shall be recognized as null and void: ___________________.

Article 5

  1. To establish that within the period up to _____________ [six months from the entry into force of this Act], on the basis of a separate temporary law adopted by the Congress of People's Deputies, elections will be held in the bodies of local self-government of the Russian Republic within the boundaries of the municipalities that existed in the Russian Federation as of ________.
  2. To recommend that the Constitutional Working Group, in the course of preparing the draft of the new Constitution of the Russian Republic and its nationwide discussion, establish a period for holding the first free federal-level elections in the Russian Republic no later than one year from the date of adoption of the new Constitution by referendums in the constituent entities of the Russian Republic.

Article 6

  1. To establish a Transitional Administration (government) of the Russian Republic with a staff of 21 persons.
  2. Elections to the Transitional Administration of the Russian Republic shall be held by the Congress of People's Deputies in accordance with the Regulations on the Transitional Administration adopted by the Congress.
  3. At its first meeting, the Transitional Administration shall elect a Chairman from among its members and appoint the heads of the federal executive authorities. These appointments are subject to approval by the Congress of People's Deputies.
  4. The Transitional Administration shall exercise its powers on the basis of the Regulations adopted by the Congress of People's Deputies until a new Government of the Russian Republic is elected in accordance with the Constitution of the Russian Republic.
  5. In forming its structures and in its regulatory and normative activities, the Transitional Administration shall be guided by the generally recognized principles and norms of international law, as well as the legal acts, standards and approaches of the European Union.
  6. The functions of representing the interests of the Russian Republic in the international arena in international relations, as well as the functions of supreme commander-in-chief of the Armed Forces of the Russian Republic, shall be vested in the Chairman of the Transitional Administration of the Russian Republic.

Article 7

  1. Political organizations and associations that have existed in the Russian Federation shall be dissolved.
  2. New political organizations and associations shall be established after the entry into force of the new Constitution in accordance with the procedure provided for by the new Constitution of the Russian Republic.

Article 8

  1. To form the Public Security Service of the Russian Republic, which shall carry out counterintelligence and anti-terrorist activities on the territory of the Russian Republic in accordance with the law adopted by the Congress of People's Deputies.
  2. To reorganize by transformation the Investigative Committee of the Russian Federation into the Federal Bureau of Investigation of the Russian Republic, which shall investigate criminal offences committed on the territory of the Russian Republic in accordance with the law adopted by the Congress of People's Deputies.
  3. To liquidate the Main Directorate for Countering Extremism and its subdivisions within the Ministry of Internal Affairs of the Russian Federation.
  4. To separate from the Ministry of Internal Affairs of the Russian Federation and its subordinate structures the subdivisions engaged in operational and investigative activities and to transfer them to the Federal Bureau of Investigation of the Russian Republic.
  5. To separate from the Prosecutor's Office of the Russian Federation the subdivisions engaged in support of investigative activities and transfer them to the Federal Bureau of Investigation of the Russian Republic.
  6. To reorganize by transformation the Ministry of Justice of the Russian Federation into the Department of Justice of the Russian Republic, acting in accordance with the law adopted by the Congress of People's Deputies. To entrust the functions of representing the state in courts and prosecutorial supervision to the Department of Justice of the Russian Republic.
  7. To transfer the functions and personnel of the Prosecutor's Office of the Russian Federation and its subordinate structures to the Department of Justice of the Russian Republic. To liquidate the Prosecutor's Office of the Russian Federation.
  8. To reorganize by transformation the Ministry of Internal Affairs of the Russian Federation and its subordinate structures into the Department of Internal Affairs of the Russian Republic, which shall perform the functions of protecting public order and controlling the observance of laws on the territory of the Russian Republic, in accordance with the law adopted by the Congress of People's Deputies.
  9. To separate the Federal Border Guard Service of the Russian Federation from the Federal Security Service of the Russian Federation and subordinate it to the Department of Internal Affairs of the Russian Republic. The crossing of the state border of the Russian Republic shall be suspended until the Transitional Administration of the Russian Republic adopts new rules for crossing the state border.
  10. To separate from the Federal Security Service of the Russian Federation [units dealing with economic and information security] and transfer them to the Federal Bureau of Investigation of the Russian Republic.
  11. To liquidate the Federal Security Service of the Russian Federation.
  12. To instruct the leadership of the Federal Security Service of the Russian Federation to transfer its affairs and property to the leadership of the Public Security Service of the Russian Republic within one month of the entry into force of this Act.
  13. To entrust the leadership of the Prosecutor's Office of the Russian Federation to transfer the affairs and property to the leadership of the Department of Justice of the Russian Republic within one month from the entry into force of this Act.
  14. The Public Security Service of the Russian Republic shall, within two months of its establishment, open public access to the archives of the Federal Security Service of the Russian Federation and subdivisions of the Main Directorate for Countering Extremism of the Ministry of Internal Affairs of the Russian Federation with regard to information on the activities of informants, full-time and freelance agents of these bodies who carried out operational and investigative activities [with regard to persons covered by the Rehabilitation Act]. Organize public access to information on the above informants and agents, including materials of their personal files, via the Internet.
  15. Instruct the Department of Justice of the Russian Republic, in accordance with the Rehabilitation Act, to carry out the immediate release of political prisoners in places of detention and imprisonment.

Article 9

  1. To liquidate the Administration of the President of the Russian Federation.
  2. Transfer the property of the Administration of the President of the Russian Federation to the Transitional Administration of the Russian Republic.
  3. Transitional Administration of the Russian Republic within a month from the moment of coming into force of the present Act to establish the order of transfer of a complex of buildings, previously owned and (or) occupied by the Administration of the President of the Russian Federation and the President of the Russian Federation on the territory of the Kremlin, to the management of the federal museum complex "Moscow Kremlin".
  4. Buildings and property of representative offices of the President in federal districts to transfer in management to administrations of subjects of the Russian Federation on which territory these buildings and property are located.
  5. Transitional Administration of the Russian Republic within a month from the entry into force of this act to organize the funeral of Lenin V.I. on the territory of the city of St. Petersburg. The building of the Lenin Mausoleum shall be transferred to the Historical Museum for the purpose of organizing the Museum of Political Repression and Investigation in the Russian Empire, the USSR and the Russian Federation.

Article 10

The Security Council of the Russian Federation shall be liquidated. The property of the Security Council and its subordinate structures shall be transferred to the Transitional Administration of the Russian Republic.

Article 11

To make Article 9 of the Federal Law of 08.12.2020 № 394-FZ "On the State Council of the Russian Federation" in the following wording: "1. The members of the State Council shall be two representatives from each constituent entity of the Russian Republic, two representatives from each of the cities of the Russian Republic with a population of over one million people, and ten representatives from the Congress of People's Deputies.

  1. Members of the State Council shall be ex officio members of the Transitional Administration of the Russian Republic.
  2. Members of the State Council shall have the right to make proposals on the work plan of the State Council, the agenda of its meetings and the procedure for discussing issues. Members of the State Council shall participate in the preparation of materials for meetings of the State Council and draft decisions of the State Council, as well as in meetings of the State Council.
  3. Members of the State Council shall not have the right to delegate their powers to other persons."
  • To make paragraph 1 of Article 8 of Federal Law No. 394-FZ of 08.12.2020 "On the State Council of the Russian Federation" in the following wording: "The State Council shall elect at its meeting the Chairman of the State Council. His powers shall be retained for the period until the next meeting of the State Council. The same person may not hold the office of Chairman of the State Council for more than one consecutive term".
  • To entrust the State Council of the Russian Republic with the authority to harmonize legislative acts adopted by the Congress of People's Deputies. In order to exercise this authority, the State Council shall have the right to initiate the procedure for coordinating the adopted act within a period of no more than two weeks after the Congress of People's Deputies adopts the legislative act. Within a period of not more than one month from the beginning of consideration of a legislative act, the State Council shall either adopt a decision to approve the act or return it to the Congress of People's Deputies with its comments for reconsideration. If the State Council fails to initiate the procedure of agreement within the time limits set forth in this Article and fails to adopt a decision to agree or return the act to the Congress of People's Deputies, the act shall be deemed to have been agreed upon.
  • To grant the State Council of the Russian Republic the right to submit legislative initiatives to the Congress of People's Deputies.
  • To oblige the Transitional Administration and the Constitutional Working Group to take into account the decisions of the State Council in their activities.
  • To propose that the State Council of the Russian Republic meet as soon as possible in a joint session with the Congress of People's Deputies and the Transitional Administration to consider issues related to the formation of the new organs of power of the Russian Republic and the preparation of a nationwide discussion and adoption of the Constitution of the Russian Republic.

Article 12

This Act shall enter into force ___________________________.
